Fraud occurs when a will is made in your name without your knowledge or consent.  Unlike undue influence if you or your beneficiaries are a victim of fraud you may not know about it.

Fraud occurs where someone makes a will.  They will either pretend to be you by telling a legal services provider (such as us or a traditional solicitor) that they are you.  Alternatively they may make a will using a will “kit” from a stationers.  In either case they can forge your signature or trick you into signing the will.

If you believe you are a victim of fraud please report this to the police and also to those closest to you as soon as it is safe to do so.

You should also update your will, store it safely, and ensure that your executors know where it is stored and how to access it.
