I have an Enduring Power of Attorney (EPA). Is this still valid?
An Enduring Power of Attorney (EPA) is an older style of power of attorney made before 1 October 2007, before they were replaced by LPAs. Whilst an EPA can still be used if you have one, it only allows people to make decisions for you about your property and finances, and not your health and welfare. In addition, an EPA can only be registered and used once you are losing or have lost mental capacity to make decisions for yourself.
Because of the restrictions on the use of an EPA, many people choose to replace these with LPAs for both property and finances and health and welfare. Alternatively, you may wish to keep your existing EPA.
